First Case on Survivor Benefits in Same-Sex Couples Rules in Favor of Lesbian Widow

A Pennsylvania judge has awarded Jennifer Tobits survivor benefits after her wife, Sarah Ellyn Farley passed away.

After Farley’s passing her parents, who did not recognize her marriage to Tobits, went after death benefits from the law firm Farley worked for, the firm filed action to see who the benefits were actually owed to in the way of the DOMA ruling which legalized same-sex marriage in June.

Judge C. Darnell Jones II ruled in favor of Tobits, saying that she was definitely Farley’s spouse, in accordance to the new definition of the word.

Seeing the new rulings regarding same-sex marriage in America actually going into effect makes the fight for equality seem all the more tangible.
