While voters in South Dakota have decided to ban same-sex marriage, District Court Judge Karen E. Schreier has something different to say.
As of Monday, the state is being forced to allow gay marriage to take place, however the judge stayed her ruling pending appeal, so while her decision makes the marriages legal, they cannot take place just yet.
Four gay marriage cases are waiting review by the Supreme Court, which will most likely ultimately resolve the entire issue of same-sex marriage in the United States.
Schreier said in her decision, “Plaintiffs have a fundamental right to marry. South Dakota law deprives them of that right solely because they are same-sex couples and without sufficient justification.”
We can only hope that the Supreme Court will feel the same way.
